International Arbitration in Switzerland
In the 20th century, arbitration has received a substantial boost, together with the upward movement of international trade. Its geographical situation, neutrality and political stability have helped Switzerland to become a popular place of arbitration. Switzerlands modern lex arbitri, Chapter 12 of the PILS, has contributed substantially to its position as a place of arbitration. The tradition of being a neutral place of arbitration, the appeal of Swiss law and the modern lex arbitri have leveraged Switzerlands prominent standing. Switzerland is one of the most important centers of international arbitration today. This 'nutshell' - book illustrates the current legal situation of international arbitration in Switzerland by presenting the legal environment through references to important rules for arbitration in Switzerland (in particular the Swiss Rules of International Arbitration, the Rules of Arbitration of the International Chamber of Commerce ICC and the UNCITRAL Arbitration Rules) and illustrating figures. The structure of the book follows a well-established pattern, beginning with the basics of the arbitration agreement, the course of arbitral proceedings up to the arbitral award and its recognition and enforcement in Switzerland and abroad. The authors goal is to provide a pragmatic introduction to international arbitration in Switzerland. The book is therefore addressed to practitioners, with or without a background in law as well as to law students.
