Marken verleihen ein subjektives ausschließliches Recht. Die Reichweite dieses Markenrechts ist jedoch höchst umstritten, was in der Praxis bereits zu zahlreichen Vorabentscheidungsverfahren vor dem EuGH geführt hat. Dabei spielt insbesondere die Auslegung des Tatbestandsmerkmals der »Benutzung« einer Marke eine zentrale Rolle. Die Neuformulierung der Verletzungstatbestände und Schrankenregelungen im Zuge der europäischen Markenrechtsreform 2015 sowie die Rechtsprechung des EuGH im Fall »Mitsubishi« bieten in diesem Zusammenhang Anlass zu weiteren Untersuchungen. Ziel dieser Arbeit ist es, einen in systematischer Hinsicht stimmigen Benutzungsbegriff zu finden, der einheitlich auf alle Verletzungstatbestände anwendbar ist und bei dem allen Schrankenregelungen ein eigenständiger Anwendungsbereich verbleibt. However, the scope of this trademark right is highly controversial, which in practice has already led to numerous preliminary ruling proceedings before the ECJ. In particular, the interpretation of the term “use” of a trademark plays a central role. The revisions of the elements of infringement and of the limitation provisions in the course of the 2015 trademark law reform as well as the case law of the ECJ in the “Mitsubishi” case provide grounds for further investigations in this context. The aim of this thesis is to find a concept of the term “use” that is consistent from a systematic point of view, that is uniformly applicable to all elements of infringement and that leaves a distinct scope of application for all provisions on limitations.
