Urheberrechtlich geschützte Werke in Form von u.a. Bildern, Texten, Videos und Musikwerken werden von Nutzern sozialer Medien hochgeladen und untereinander ausgetauscht. Victoria-Sophie Stracke beschäftigt sich mit der Frage, welche Handlungsmöglichkeiten ausgewählte soziale Medien für ihre Mitglieder zur Verfügung stellen und ob durch diese eine öffentliche Wiedergabe nach § 15 Abs. 2 UrhG stattfindet. Bei der Untersuchung dieser Nutzerhandlungen berücksichtigt sie insbesondere die Rechtsprechung des Europäischen Gerichtshofes zur Auslegung der öffentlichen Wiedergabe nach Art. 3 Abs. 1 InfoSoc-RL. Zudem geht die Autorin auch auf die für Nutzer anwendbaren Schrankenbestimmungen ein und untersucht die Verantwortlichkeit der Betreiber sozialer Medien für Rechtsverletzungen durch die Nutzer. Copyrighted works in the form of images, texts, videos and musical works, among others, are being uploaded by social media users and shared amongst one another. Victoria-Sophie Stracke deals with the question as to which options certain social media make available to their users and whether, due to said options, the right of communication to the public goes in compliance with Section 15 (2) of the German Act on Copyright and Related Rights (UrhG). In studying users’ actions, she carefully considers case law of the European Court of Justice on the author’s right of communication to the public under Article 3 (1) of the Information Society Directive. In addition, the author also examines the limits governing users whilst investigating what responsibility social media operators hold for infringements by their users.
