This revision takes account of recent developments in the rapidly evolving field of matrimonial property law. This includes new case law on the interrelationship between claims to reallocation of assets and maintenance upon divorce, as well as the demarcation between the revived notion of “marital partnership” in matrimonial property law and transfers to spouses. Also incorporated are the eagerly awaited decisions of the Bundesgerichtshof on the validity of clauses in ante-nuptial agreements and out-of-court divorce settlements, decided within the constraints imposed by the Federal Constitutional Court.
