Far-reaching controversy has resulted from the thesis advanced by the German Federal Court of Justice (BGH) that the mere granting of authorization by a seller of real estate (Vormerkungsschuldner) is sufficient for the reactivation of a provisional entry (Vormerkung) that was deleted from the real estate register due to the loss of a secured claim. The new provisions of § 889a raise a number of new problems, which are addressed in this volume.
